(Online Load Board Platform)
Consent in terms of the Protection of Personal Information Act, 4 of 2013 ("POPIA")
LoadBoardSA (Pty) Ltd ("LoadBoardSA", "we", "us", or "our") operates an online load board platform that enables clients and transporters to transact directly, including the ability to register, advertise loads or vehicle availability, communicate, book, and manage loads electronically via the platform.
LoadBoardSA acts as a facilitating technology platform only and does not act as a contracting party, agent, broker, carrier, or principal in respect of any transaction concluded between users, unless expressly agreed otherwise in writing.
The personal information processed by LoadBoardSA in the course of user registration, platform usage, and related services falls within the ambit of the Protection of Personal Information Act, 4 of 2013 ("POPIA").
The purpose of this document is to inform users of how personal information is processed and to obtain voluntary, informed, and specific consent where required.
By registering on, accessing, or using the LoadBoardSA platform, you confirm that:
You understand that you are under no obligation to consent to the processing of your personal information;
Your consent applies only to the processing activities described in this document;
Certain personal information is necessary to enable platform functionality, including registration, advertising, booking, and load management.
You acknowledge that refusal or withdrawal of consent in respect of essential information may limit or prevent your ability to use the platform.
For purposes of POPIA, "personal information" processed by LoadBoardSA may include, but is not limited to:
Full names, surname, identity number or passport number (natural persons);
Company or Close Corporation name, registration number, VAT number, and business details (juristic persons);
Contact details such as email address, mobile number, physical or business address, and geographic location;
User profile information, including role classification (client, transporter, broker);
Load details, vehicle details, route information, availability, and operational data voluntarily submitted;
Banking or verification details where required for compliance or platform-related processes;
Communications exchanged via the platform, including messages, enquiries, and support interactions;
Information required in terms of the Financial Intelligence Centre Act, 38 of 2001 (FICA), where applicable;
Any other information voluntarily provided for purposes of transacting on or using the platform.
Note: Certain information may constitute special personal information as contemplated in Section 26 of POPIA and will only be processed where lawful, necessary, and adequately safeguarded.
Personal information is processed lawfully, minimally, and transparently, strictly for legitimate platform-related purposes, including but not limited to:
Creating, verifying, and managing user accounts;
Enabling direct interaction and transactions between clients and transporters;
Advertising and displaying loads, vehicle availability, routes, and service offerings;
Facilitating booking, allocation, and management of loads between users;
Sharing relevant contact and transactional information between users to enable execution of bookings;
Maintaining records of listings, bookings, communications, and load activity for operational, compliance, and dispute-resolution purposes;
Platform notifications, system alerts, and service communications;
Industry-related notices, surveys, events, newsletters, and updates;
Platform security, fraud prevention, moderation, analytics, and system improvement.
By using the platform, you acknowledge and consent to receiving:
Platform-generated emails, alerts, and notifications;
Transactional and operational communications;
Industry and informational communications (with opt-out options where applicable);
Communication via official LoadBoardSA WhatsApp groups or digital channels, where you have voluntarily joined such groups.
By accepting this consent, you acknowledge and agree that LoadBoardSA may:
Collect personal information directly from you or from lawful third-party sources;
Store, update, modify, retrieve, and archive personal information for platform purposes;
Share relevant personal and business-related information with other platform users strictly to enable direct transactions, load bookings, and load management;
Transmit personal information to third-party service providers within South Africa who assist in operating or maintaining the platform;
Transmit personal information to third parties in foreign jurisdictions that provide an adequate level of protection as required under Section 72 of POPIA.
LoadBoardSA does not sell personal information to third parties.
Personal information will be retained:
For the duration of your active relationship with LoadBoardSA; and
Thereafter for such period as required by applicable legislation, contractual obligations, or legitimate business purposes.
Once no longer required, personal information will be securely destroyed, anonymised, or de-identified.
In terms of POPIA, you have the right to:
Request access to your personal information;
Request correction or deletion of inaccurate, irrelevant, or excessive personal information;
Object to the processing of your personal information;
Withdraw consent, subject to legal, regulatory, and operational limitations;
Lodge a complaint with the Information Regulator.
Requests must be submitted in writing in accordance with Section 24 of POPIA, using the prescribed prescribed form where applicable.
